The Christiana Spine Center, LLC is a separate name-only entity and does not have separate liability coverage. Physiatrist Associates, P.A. employs Drs. A L Cucuzzella, TR Cucuzzella, EG Delport, N Kim, ST Roberts, FB Sarlo and Christiana Spine Consultants, P.A. employs Dr. J. Rush Fisher. These are separate entities and practice and do business under their separate corporations. All aforementioned physicians are not considered partners, employees, agents and/or servants of the Christiana Spine Center, LLC.

- This World Wide Web site with its home page in the domain 'christianaspinecenter.com', hereinafter referred to as the Website, is an information service provided by Christiana Spine Center, hereinafter referred to as CSC, at no charge to users of the World Wide Web, with the express condition that these users agree to be bound by the terms and conditions set forth in this Terms of Use Agreement. CSC reserves the right to change these terms and conditions at any time, and you agree to abide by the most recent version of this Terms of Use Agreement each time you view and use the Website. We know that medical information about you and your health is private. We do our best to protect medical information about you. The purpose of this Notice is to explain to you how we protect your information and what rights you have regarding your information. You have the right to receive a Notice of Privacy that tells you in detail how everyone here at Christiana Spine Ambulatory Surgery Center, LLC protects your rights. By everyone, we mean doctors, nurses, x-ray technicians, receptionists, bookkeepers, physical therapists, physician assistants, secretaries and anyone else who might see your information or put information into your record(s). Your personal doctor may have different policies or notices regarding the doctor's use and sharing of your medical information created in the doctor's office or clinic.
We are required by law to:
- Make sure that your information is kept private.
- Tell you about the rules and laws we must follow.
- Do what this notice says.
How Christiana Spine ASC, LLC can use your information:
The following tells you the ways that we use and give out medical information. We will explain what we mean and give some examples. This will not tell you about each and every single way we may use or give out your information. However, all of the ways we are allowed to use and give out information will fall within one of the headings listed.
- To take care of you. We may use your health information to give medical treatment or services. We may give out medical information about you to doctors, doctors in training, nurses, students or other people in the ASC who are part of your care here. We may also give out medical information to work with and manage your health care with a third party. We may also give out medical information about you to people outside the facility who may be helping with your care after you leave here.
- To get paid. We may use and give out health information about you so that the care you receive here will get paid by you, an insurance company, or a third party. For example, we may need to give your health plan information about care you received, so that your insurance will pay us for the care. We may also tell your health plan about care you are going to get to find out if they will pay for your care.
- To run the ASC. We may use and give out medical information about you in order to run the ASC and make sure that all of our patients receive good care. For example, we may use medical information to see how we took care of you and see how our staff is caring for you. We may also put together medical information about many patients to decide if there are other services the ASC should offer, what services are not needed, and what new treatments are effective. Doctors, nurses, students, and people taking care of you, may receive information for review and learning purposes. Information may be combined with medical information from other facilities to compare how we are doing and see if we can do better in the care and services we offer. This information would not include your name so others may use it to study health care and health care delivery without learning the names of patients.
- To contact you. We may contact you for appointment reminders or to tell you about or recommend services for your health or possible treatment options or alternatives that may be of interest to you.
- Family and friends. We may release medical information about you to a friend or family member who is involved in your medical care. This would include persons named in any health care power of attorney or similar document provided to us. We may also give information to someone who helps pay for your care. In addition, we may give out medical information about you to an agency helping in a disaster relief effort so that your family can be contacted about your condition, status, and location.
- Research. In most cases, we will ask for your written approval before using your medical information or sharing it with others in order to conduct research. However, we may use and give your health information without your approval in the following ways:
- If we have gone through a special process and have assured your privacy rights will not be affected.
- To people within Christiana Spine Ambulatory Surgery Center who are preparing a research project or trying to get patients involved in research. In the event of death, we may share health information with people who are doing research using the information on people who have died, as long as they agree not to share any information that can identify a person, outside of Christiana Spine Ambulatory Surgery Center.
- Special situations. We may give out information about you without your permission in the following situations:
- As required by law. When we are required to do so by federal, state, or local law.
- To help avoid a serious threat to health or safety. To help avoid a threat to your health and safety or the health and safety of the public or another person. Any information we give out, however, would only be to someone able to help prevent the threat.
- Military and veterans. If you are a member of the armed forces, we may release medical information about you as required by military command authorities. We may also release medical information about foreign military personnel to the appropriate foreign military authority. We may give out to the Department of Veterans Affairs medical information about you to find out if you can get certain benefits.
- Workers’ compensation. For workers’ compensation or other programs that provide benefits for work-related injuries or illness.
- Public Health authorities. For Public Health activities, such as:
- To report disease outbreaks.
- To report births, deaths, child or elder abuse or neglect.
- To report reactions to medications or problems with products
- To notify people of recalls of medications/products they may be using.
- To notify a person who may have been exposed to a disease or may be at risk for getting or giving someone else a disease or condition.
- Health oversight activities. For activities allowed by law that are necessary for the government to monitor the health care system, government programs, and make sure facilities are following the civil rights laws. These oversight activities include audits, investigations, inspections, and licensure.
- Lawsuits and disputes. If you are involved in a lawsuit or a dispute, we may give out medical information about you if we get a valid court or administrative order, subpoena, discovery request, or other lawful process by someone else involved in the case, but only if efforts have been made to tell you about the request or to obtain an order protecting the information requested.
- Law enforcement. If we are asked to do so by law enforcement officials or are required to do so by law:
- In response to a valid court order, subpoena, warrant, summons, or other similar process.
- To identify or find a suspect, fugitive, material witness, or missing person.
- To report about the victim of a crime if, in certain cases, we are unable to get the person to agree.
- To report about a death we think may be the result of criminal conduct.
- To report criminal conduct at the ASC.
- In emergency cases to report a crime, the location of the crime or victims, or the identity, description, or location of the person who committed the crime.
- Coroners, medical examiners, and funeral directors. To a coroner or medical examiner to identify a person who has died or find out the reason the person died. We may also give out medical information about a patient who has died to funeral directors so they can carry out their duties.
- National security and intelligence activities. To authorized federal officials for intelligence, counterintelligence, and other national security activities authorized by law. This includes the protection of the President or foreign heads of state.
- Prisoners. If you are a prisoner of a correctional institution or under the custody of a law enforcement official, we may release medical information about you to the correctional institution or law enforcement official.
When we need your written permission to give out your medical information:
We will need your written permission to use or give out your medical information for reasons not covered by this notice or the laws that apply to us. If you give us permission, you may take back that permission, in writing, at any time. If you take back your permission, we will no longer use or share medical information about you, except to take care of you, get paid and to run the facility. You understand that we are unable to take back any information we have already shared with your permission and that we have to keep our records of the care that we have given you.
You have the following rights:
- Right to look at and copy. Most of the time, you have the right to look at and get a copy of your health information that may be used to make decisions about your care. This includes medical and billing records. To look at or get a copy of your health information, please write to our Privacy Officer, listed below. If you ask for a copy of the information, we may charge a fee for the costs of copying, mailing or other supplies.
On rare occasions, we may not be able to let you see or get copies of your records. If this happens, we will provide a written reason and tell you about your rights to have that decision looked at by someone else who was not involved in the first decision. If we have reason to not let you see or get copies of part of your record, we will let you see or get a copy of the rest of the information.
- Right to amend. If you feel that medical information we have about you is incorrect or incomplete, you may ask us to amend the information. You have the right to ask for an amendment for as long as the information is kept by the facility. To ask for an amendment, you must write to the Privacy Officer and provide a reason for your request. We may deny your request if you ask us to amend information that:
- Was not created by us, unless the person or entity that created the information is no longer available to make the amendment.
- Is not part of the medical information kept by or for Christiana Spine ASC.
- Is not part of the information that you would be permitted to inspect and copy.
- Is accurate and complete.
You have a right to submit a written statement to the Privacy Officer disagreeing with a denial of your request for an amendment.
- Right to a list of disclosures. You have the right to request an "accounting of disclosures" or a list of whom outside of the facility has received information about you. This does not apply to information provided to take care of you, for Christiana Spine ASC to get paid, or to run the ASC. To ask for this list, you must put your request in writing to the Privacy Officer. Your request must state a time period that may not be longer than six years. The first list you ask for within a 12-month period will be free. If you want more lists we may charge you for the costs of providing the list. We will tell you the cost and get your approval before we mail the list.
- Right to ask for limits. You have the right to ask us to limit the medical information we use or give out about you to take care of you, to get paid, or to run the ASC. You also have the right to ask for a limit on the medical information we give out about you to someone who is involved in your care or the payment for your care, such as a family member or friend. We may not be able to agree to your request. If we do agree, we will do as you ask unless the information is needed to provide you emergency treatment. To ask for limits, you must send your request to the Privacy Officer, in writing. In your request, you must tell us (1) what information you want to limit; (2) whether you want to limit our use, how we share your information, or both; and (3) to whom you want the limits to apply, for example, information to your spouse.
- Right to confidential communications. You have the right to ask us to get information to you by using a different address or phone number. When you provide your address when registering for services, you need to tell us you would like a second address or phone number to be used.
- Right to a paper copy of this notice. To get a copy of this notice, ask for a copy from the Reception Desk.
- Right to be notified in the event of a breach. You have the right to be notified that Christiana Spine ASC, LLC has knowledge or a reasonable belief that a breach of your unsecured Protected Health Information has occurred or may have occurred.
Changes to this notice
We can change this notice. If this notice is changed it will apply to information we already have about you as well as any information we receive in the future. We will post a copy of the current notice in the facility and on our Web site: www.christianaspinecenter.com. The notice will contain on the first page, the effective date. When you register for services or are admitted to the ASC, we will offer you the notice in effect at that time. You will be asked to sign a statement acknowledging that you received this notice. If the privacy notice changes or 3 years have passed since you first signed the document, you may be required to sign a new privacy notice statement.
Complaints
If you think your privacy rights have been violated, or if you disagree with a decision we made about your records, you may file a complaint with us by writing to our Privacy Officer providing enough detail to allow us to look into the matter. You will not be treated any differently for filing a complaint.
